In New Jersey, coverage is regulated by the "Individual Health Coverage" (IHC) Program Board. An eligible applicant must be a resident of New Jersey for at least 6-months of the year.

Coverage is issued on a "guaranteed" basis. However, a 12-month pre-existing condition clause may apply to a condition which manifested itself, within a 6-month "look-back" period, in such a manner that would cause a prudent person to seek advice, care or treatment, or for which advice, diagnosis, care or treatment was recommended or received. Pregnancy is also considered a pre- existing condition. A pre-existing limitation may not apply to an eligible person who has "creditable coverage" with no intervening lapse in coverage of more than 31 days, or if the person had satisfied a 12-month limitation under the prior plan. Persons who also meet the definition of a "federally defined eligible person" (18-months or more of creditable coverage) may not be subject to a pre-existing condition limitation if they apply for coverage within 63 days of termination of their prior group coverage.
